Hi! I'm Lisa. I work in TV and film as writer, producer & editor. This is my blog about the work I do and the news, trends and technologies that touch it. With the occasional totally unrelated bits thrown in.

A few months back a producer from the Simpsons contacted Carly about using her song ‘everyday’ for an upcoming episode in which they were going to parody my video. She was negotiating a rate for the song, until they never got back to her. No fee was agreed on, no contracts signed. She and I both assumed that they were no longer interested in using her song for the show. Last night the episode aired and sure enough her song is part of the show.
What’s up with that?!I am thrilled that the Simpsons parodied me, but Carly should have been compensated.

This is really unfortunate, because it just perpetuates the idea that BIG TV is stealing from The Little Guy (which, if the matter remains unresolved, would appear to be the case). However, knowing how things work (or not work) in the TV world, it’s just as plausible that this is an issue of someone at the production company (Gracie Films) or the distributor (Fox) dropping the ball, rather than the producer intentionally trying to cheat Carly out of rightful compensation. It’s also possible that the producer still intends to close the loop; I mean, ideally all footage and music is cleared before a show airs, but sometimes the paperwork doesn’t get finished until well afterward.
I would urge Carly to contact Gracie Films directly, and see what’s up. Talk directly to the show’s producer. If you feel you’re getting no traction there, consult a lawyer. But definitely follow up. Don’t think that your opportunity for fair compensation has passed just because the episode has already aired.
Good luck! Please keep us let us know what happens with this.
